No Pedal, No Problem: NHTSA Just Made the Tesla Cybercab Street-Legal(image)

The U.S. regulatory wall that kept steering-wheel-less cars off public roads is finally crumbling. On the heels of Tesla cranking up Cybercab production at Gigafactory Texas, the National Highway Traffic Safety Administration (NHTSA) has proposed a game-changing update to the Federal Motor Vehicle Safety Standards (FMVSS). The new rule would explicitly remove the requirement for a manual brake pedal in vehicles designed exclusively for full self-driving. That means the Tesla Cybercab – built from the ground up without a steering wheel or pedals – could soon get a clear federal path to deployment.

And Tesla isn't waiting around. Just weeks after mass production began in late April, drone footage has revealed over 100 Cybercabs sitting in the Giga Texas outbound lot, with another 50+ staged in Dallas. The pieces are moving fast – both in Austin and in Washington.

1. NHTSA’s Fifth Round of FMVSS Revisions

NHTSA has formally initiated the fifth round of updates to FMVSS, specifically targeting Standard No. 135 (brake systems). The goal is to eliminate the mandate for manual brake pedals on vehicles equipped with an Automated Driving System (ADS) – vehicles that are never intended to be human-driven. This regulatory shift acknowledges that rules designed for the Ford Model T era don't fit a robotaxi with no driver's seat.

NHTSA Administrator Jonathan Morrison called this "the most profound transformation in automotive technology since the Model T." The agency is walking a tightrope: removing outdated barriers to innovation while strengthening safety accountability through performance-based standards and recall authority.

Key Point: Removing the pedal mandate doesn't mean lower safety standards. ADS vehicles must still meet strict braking distance requirements through alternative testing procedures. If a Cybercab retains manual controls, all existing FMVSS rules remain fully applicable.

2. What This Means for Tesla’s Cybercab

This proposed rule is tailor-made for Tesla's strategy. The Cybercab was designed from the outset to operate without human intervention, relying entirely on the Full Self-Driving (FSD) software. Before this change, removing pedals and mirrors meant a long, uncertain exemption process. Now, the federal framework is catching up to Tesla's hardware reality.

Tesla is currently producing both steering-wheel-equipped and wheel-less Cybercabs in parallel at Giga Texas. While the company had previously signaled openness to shipping with pedals if required, the NHTSA proposal effectively greenlights the pure, pedal-free vision – at least at the federal level.

3. Over 150 Cybercabs Staged – Production is Ramping Fast

This isn't a paper launch. New drone imagery from Gigafactory Texas shows more than 100 Cybercabs packed tightly in the outbound lot – the largest fleet of gold-colored robotaxis ever seen on the factory grounds. The footage, captured by @AirwaveDynamics, reveals dozens of units lined up row by row, apparently ready for road testing and potentially deployment.

But that's not all. A second massive cluster of more than 50 Cybercabs was discovered at a staging lot in Dallas (via @scotsrule08 and @SawyerMerritt). Given that Tesla expanded its unsupervised Robotaxi service to Dallas and Houston in April (with no safety drivers), the Dallas staging points to a near-term active fleet deployment.

Supply Chain Clue: Giga Texas is building a mix – both pedal-free and steering-wheel-equipped units. This suggests Tesla is hedging against state-level rules while preparing for a federal go-ahead, possibly designing the controls to be easily removable later.

4. A Broader Federal Push for AV Regulation

This federal move isn't an island. The Department of Transportation is advancing on multiple fronts:

  • Streamlined exemptions for AV demonstration and commercial fleets, now including domestic manufacturers.

  • Concurrent updates to standards for shift mechanisms (FMVSS 102), defogging (103/104), and tire labeling (110).

  • Drafting the first major federal safety guidance for AV developers since 2017.

  • Hosting the inaugural National Autonomous Vehicle Safety Forum.

The Autonomous Vehicle Industry Association (representing Waymo, Zoox, and others) is pushing hard for a unified federal policy, and Tesla CEO Elon Musk has been actively lobbying in Washington for a national AV framework. Once these updates are finalized, the individual exemption process may become obsolete.

5. SAE Level 4 Certification & The Road to Deployment

Tesla recently secured SAE Level 4 autonomous certification for its FSD-driven vehicles under a new Texas law – clearing state-level commercial operation hurdles. But the federal brake-pedal rule was the last major regulatory puzzle piece.

What about the hardware? Tesla has also announced a mid-cycle "HW 4.1" (or HW4+) FSD computer with 64GB of total RAM (32GB per chip), a 10% boost in compute and memory bandwidth, and production expected in mid-2027. While some speculated Tesla would wait for FSD v15 (with a 10x parameter upgrade) before scaling Robotaxi, the presence of 150+ staged Cybercabs suggests they might move sooner – potentially with upgradeable hardware paths.
